But not all theft charges are treated the same way under Canadian law.<\/p>\n\n\n\n<p>There is a significant legal difference between stealing a lower-value item and stealing property worth thousands of dollars. In Ontario, that dividing line is <strong>$5,000<\/strong>.<\/p>\n\n\n\n<p>If you are facing a theft charge, understanding how your case is classified is critical to knowing what you are up against.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Theft Under Canadian Law<\/h2>\n\n\n\n<p>Under the <em>Criminal Code of Canada<\/em>, theft occurs when someone fraudulently and without colour of right takes, converts, or deprives the owner of property \u2014 either permanently or temporarily.<\/p>\n\n\n\n<p>The law divides theft into two main categories:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Theft under $5,000<\/strong><\/li>\n\n\n\n<li><strong>Theft over $5,000<\/strong><\/li>\n<\/ul>\n\n\n\n<p>The commonly used term \u201cshoplifting\u201d is not a legal charge. It is generally prosecuted as an indictable offence, meaning the potential penalties are higher.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Potential Consequences<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Maximum sentence of up to <strong>10 years imprisonment<\/strong><\/li>\n\n\n\n<li>Criminal record<\/li>\n\n\n\n<li>Employment and professional consequences<\/li>\n\n\n\n<li>Travel restrictions (including to the United States)<\/li>\n\n\n\n<li>Possible immigration consequences for non-citizens<\/li>\n<\/ul>\n\n\n\n<p>If charged, you may be arrested and required to attend a bail hearing. Whether you are released depends on factors such as your criminal record, ties to the community, and the specific circumstances of the allegation.<\/p>\n\n\n\n<p>In some cases, you may have the option to elect the mode of trial (judge alone or judge and jury). Strategic decisions like this should always be discussed with your defence counsel.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Sentencing Considerations<\/h3>\n\n\n\n<p>Courts consider a number of factors when determining sentence, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The value of the property<\/li>\n\n\n\n<li>Whether the offence was planned or opportunistic<\/li>\n\n\n\n<li>Your prior criminal record (if any)<\/li>\n\n\n\n<li>Restitution or repayment<\/li>\n\n\n\n<li>Personal circumstances<\/li>\n<\/ul>\n\n\n\n<p>A first-time offender is generally treated differently from someone with a significant criminal history.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">Theft Under $5,000<\/h1>\n\n\n\n<p>Theft under $5,000 is a hybrid offence. This means the Crown can choose to proceed either by indictment (more serious) or summarily (less serious), depending on the facts of the case.<\/p>\n\n\n\n<p>This charge is far more common in Ontario.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Common Examples<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Retail theft (shoplifting)<\/li>\n\n\n\n<li>Employee theft<\/li>\n\n\n\n<li>Package theft<\/li>\n\n\n\n<li>Gas theft<\/li>\n\n\n\n<li>Theft from shared spaces (locker rooms, gyms, workplaces)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Potential Penalties<\/h3>\n\n\n\n<p>If the Crown proceeds summarily, the maximum penalty is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Up to <strong>2 years less a day in jail<\/strong>, and\/or<\/li>\n\n\n\n<li>A fine<\/li>\n<\/ul>\n\n\n\n<p>However, jail is not automatic \u2014 especially for first-time offenders.<\/p>\n\n\n\n<p>In appropriate cases, it may be possible to pursue:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Diversion programs<\/li>\n\n\n\n<li>Peace Bonds<\/li>\n\n\n\n<li>Conditional or absolute discharges<\/li>\n\n\n\n<li>Withdrawal of charges<\/li>\n<\/ul>\n\n\n\n<p>A discharge means you would not have a criminal conviction registered against you, which can be extremely important for employment and travel.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Bail and Court Process<\/h2>\n\n\n\n<p>Being charged with theft does not automatically mean you will remain in custody. Many individuals are released with conditions.<\/p>\n\n\n\n<p>Your first court appearance is not a trial. It is an administrative step in the process.
